LUXASIA Social Studio – TERMS & CONDITIONS

with effect from 20 June 2022 

These terms and conditions, as operated by Luxasia Pte. Ltd. (“Luxasia”), shall govern your relationship with Luxasia, including but not limited to, the use of this website to manage your account, bookings, communications, purchases and registration with Luxasia, as well as the use of and your attendance at the Luxasia Social Studio. 

By your attendance at the Luxasia Social Studio and/or usage of this website, you confirm your acceptance of these Terms. Luxasia has the right to revise these terms at any time by updating this posting. By using this website, booking the Luxasia Social Studio and/or your use of and attendance at the Luxasia Social Studio, you agree to be bound by any such revisions. Luxasia Social Studio customers are encouraged to check this page periodically to stay informed of current guidelines. 

1. All bookings are provisional until full payment of the booking fee (the “Fee”) is received by Luxasia. The Fee is payable at the time of booking. Payment is currently accepted by credit/debit card. 

2. Luxasia reserves the right to request for a refundable cash deposit of SGD 100 (the “Deposit”) upon your arrival and check-in at the Luxasia Social Studio. Subject to your compliance with these Terms and your vacating the studio and returning all equipment, fixtures and fittings in its original condition, including the complete removal of your belongings, the Deposit shall be refunded to you in full.  

3. You agree to arrive and vacate at the agreed times. No refund will be provided for your late arrival and check-in. An additional charge of SGD 150 per hour will apply for overstaying.  

4. You may set up, decorate and configure the Luxasia Social Studio in the style as you desire for your purposes, save that you shall return the premises in its original condition. No warranty is made as to the suitability of the premises or its fixtures and fittings in respect of your usage of the premises. Luxasia reserves the right to make changes to the interior and exterior of the premises at any time without notice to you.   

5. Any rescheduling of your booking is subject to availability of the premises. In the event of your cancellation of less than 5 days’ notice, the entire Fee shall be forfeited
   

6. Luxasia reserves the right in its absolute discretion to turn down or cancel any booking at any time and for any reason whatsoever and eject any customer or its guests whose behaviour is not compatible with the reputation of the premises or is unacceptable in any way. All customers are responsible for their staff’s and guests’ behaviour and welfare at all times. 

7. You shall be responsible to take any appropriate insurance against all risks for your usage of the premises, including personal accident insurance. In no event shall Luxasia and/or its affiliates be held liable for failing to safeguard against any risks created by your usage of the premises. 

8. To the extent permitted by law, Luxasia and/or its affiliates shall not be liable for any loss or damage to property belonging to you or any of your staff and guests. 

9. Any lost, broken, damaged or missing equipment, fixture or fitting shall be chargeable to you at a replacement cost.  

10. Unless otherwise permitted in writing by Luxasia, you will not bring to the Luxasia Social Studio, any pets, food and beverage, including alcohol, dangerous or hazardous substances, or objects of such weight that may cause overloading or strain to the flooring or walls of the premises. You may not add to, alter, or attach equipment, fixtures or fittings to the premises (including stands and other structures) without prior written consent of Luxasia. Use of smoke or dry ice machines are prohibited unless approved by Luxasia. 

11. You consent to Luxasia taking photographs of your usage of the Luxasia Social Studio and to use and reproduce such photographs for its marketing and advertising purposes. Luxasia shall own the copyrights of such photographs.   

12. Your booking of the Luxasia Social Studio does not constitute a lease or sublease and is only a limited license to use the premises. 

13. You acknowledge that the Luxasia Social Studio and its surroundings may be under CCTV, camera and/or video surveillance for security and safety reasons. By using the Luxasia Social Studio, you consent to and understand that your activities on the premises may be recorded. 

14. Luxasia will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations due to any act of God, war, terrorism, strike, lock out, industrial action, fire, flood, storm or other event beyond the reasonable control of Luxasia. 

15. To the maximum extent permitted by law, Luxasia and/or its affiliates will not be liable to you or your guests or any other persons permitted entry into the venue by you or by someone on your behalf, for any loss, cost, injury or damage suffered or incurred by you or such other person in connection with or arising out of: 

• any act, omission, error, default or delay by our employees, agents or subcontractors; 
• any cause beyond our reasonable control; or 
• any act or omission by you or any other third party; 

 except to the extent that such loss, cost, injury or damage is caused by our gross negligence or wilful default. Notwithstanding the foregoing, Luxasia’s aggregate  liability to you and your guests for any loss suffered for any reason whatsoever will be limited to the Fee. You will be liable for any and all liabilities, losses and costs which we may incur directly or indirectly as a result of a breach by you of these Terms, your actions or equipment or the actions or equipment of any of your guests or any persons permitted entry in the venue by you or someone on your behalf, including the death of or injury to any person and the damage to any property on the premises.

16. These Terms shall be subject to and construed according to the laws of Singapore and in respect of any dispute, the parties agree to the exclusive jurisdiction of the courts of Singapore.
